Course Description

This unit introduces studetnts to the World Trade Organization's (WTO) 1994 Agreement on Implementation of Article VII of the General Agreement on Tariffs and Trade (Valuation Agreement). This Agreement is currently in use or intended use for introduction into 150 WTO member countries and enconomines for use by Customs and industry as the method of valuing imported and exported goods. The unit focuses on the international nature of the Agreement and its legal structure which is translated into each member's national legislation.

 

Students in this unit will acquire the necessary skills and knowledge to determine the value of goods under their national legislation, based on this internationally recognised system. They will examine international practice and domestic case law as well as all methods of determining the value under the Agreement, including the impact of related parties and specific issues such as discounts, royalties and conditioned sales.
